
The Ministry of Information & Broadcasting has announced a new feature facilitating self-declaration by advertisers and advertising agencies from print, broadcast as well as digital media.
In the mandatory declaration, advertisers have to certify that the ads, in question, do not contain “misleading claims” and comply with all relevant regulatory guidelines.
In a significant move to promote transparency and consumer protection, India has implemented a new regulation requiring advertisers to submit a self-declaration certificate before publishing any advertisements. This mandate applies to all forms of advertising, including:
Television and Radio: Advertisements on these platforms must be declared through the MIB's Broadcast Seva Portal.
Print and Digital Media: Declarations for print and digital ads need to be uploaded on the Press Council of India's portal.
According to the Ministry of Information & Broadcasting, the Supreme Court had issued a directive mandating all advertisers and advertising agencies to submit a ‘Self-Declaration Certificate’ before publishing or broadcasting any advertisement.
The mandatory self-declaration requirement represents a positive step towards fostering a more responsible and trustworthy advertising landscape in India. This new regulation is likely to benefit consumers by ensuring they are exposed to accurate and ethical advertising practices.
