The Government of India has reinforced legal provisions under the Telecommunications Act, 2023 and Telecom Cyber Security Rules, 2024, warning citizens against using devices with tampered IMEIs or fraudulent SIMs to prevent telecom fraud
With the rapid expansion of mobile connectivity in India, misuse of telecommunication identifiers, particularly the International Mobile Equipment Identity (IMEI) numbers, has emerged as a serious concern. To safeguard citizens and secure telecom networks, the Government of India has strengthened laws to prevent tampering and misuse of these unique device identifiers.
The Department of Telecommunications (DoT) has reminded citizens of the stringent provisions under the Telecommunications Act, 2023. Section 42(3)(c) prohibits altering telecommunication identifiers, while Section 42(3)(e) bars obtaining SIM cards or identifiers through fraud, cheating, or impersonation. Section 42(3)(f) makes possession of devices with tampered identifiers an offense. Violations can lead to imprisonment for up to three years, fines up to Rs 50 lakh, or both. These offenses are cognizable and non-bailable, with Section 42(6) extending similar punishment to those abetting or promoting such acts.
Additionally, the Telecommunications (Telecom Cyber Security) Rules, 2024 explicitly prohibit altering IMEIs or using devices in which IMEIs can be modified.
Citizen responsibilities and verification measures
Citizens are urged to avoid using mobile devices with tampered IMEIs, procuring or assembling devices like modems, modules, or SIM Boxes with configurable identifiers, and acquiring SIM cards through fraudulent means. Handing over SIM cards to others who misuse them for cyber fraud can also result in legal liability.
To help users verify their devices, the government has introduced the Sanchar Saathi portal and mobile app, which allow verification of IMEI details, including brand, model, and manufacturer. Citizens are encouraged to use these tools to ensure the authenticity of their devices and protect themselves from telecom fraud.
Adherence to these provisions strengthens the security of India’s telecommunication ecosystem, preventing fraudulent activities while ensuring that mobile connectivity remains safe and reliable for all users.
