
On last September A 5-judge constitutional bench of Supreme court has upheld the constitutional validation of the flagship of Adhaar Scheme. Here is listed out what needs to be linked to Adhaar and what not.
Adhaar Linking Mandatory List :
1. It is mandatory to Link Adhaar with PAN card.
2. Adhaar is mandatory for Filling Income tax returns.
3. For any Govt. Welfare schemes and subsidies Adhaar is Mandatory.
Adhaar is not Mandatory for these services.
1. It is not needed to open a bank Account ( As per section 57 of the Adhaar act is stuck down)
2. Adhara also not needed to get a SIM card or Shopping online.
3. Adhaar is nit required for Admission in schools or any educational unit.
4. Adhaar is not mandatory to Appear in CBSE, UGC and NEET examinations.
After the stuck down of the Section 57 of the Adhaar act, the Govt has announced not to provide and is not mandatory for any private sectors for any service and also same is true for the Private telecom companies. Now Govt is deciding to amend this section which is tabled in the Parliament.
The DoT, in its notification issued, that telcos should prepare to adopt an alternate digital process which envisages a customer acquisition form (CAF) be embedded with live photographs of subscribers and scanned images of a proof of address and identify, which will make the entire process paperless.
The Modi Govt. now planning again to allow to demand and use the Adhaar Data for Private Companies, for an issue of a new SIM card by amendment of the Adhar Law. At the mean while as per a report, the Modi Govt. has approved the recommendations to amend the Telegraph act and Prevention of Money Laundering Act, where after the Supreme court has imposed the ban on private companies to access Adhaar data.
Here it is clear that,The amendment is in compliance with the judgement of Supreme Court ,one ruling for Privacy of Data and the other for Adhaar Act in September.
The story is clear that again the previous method will be followed by the Telecom sector to Provide SIM card and Adhaar will be mandatory. At the same time Bank will demand PAN card which should be linked to Adhaar Card.
The amendment in return creating a confusion for Section 57 of the Adhaar Data, which was trimmed by supreme court on last September.
