OpenAI is reportedly in talks to revise an existing agreement with Microsoft that currently restricts the tech giant'’s access to its most advanced models once the company achieves “artificial general intelligence” (AGI). According to reports, OpenAI is considering removing a clause that excludes Microsoft from using AGI technology when it is developed, as the company seeks to unlock further investments and expand its business prospects.
Under the current terms of the agreement, when OpenAI creates AGI—defined as a highly autonomous system capable of outperforming humans at most economically valuable tasks—Microsoft would lose its access to this technology. This clause was initially included to protect AGI from potential misuse in commercial ventures, with the ownership of AGI ultimately resting in the hands of OpenAI’s non-profit board.
However, OpenAI is now reportedly reconsidering this restriction, aiming to allow Microsoft to continue investing in and utilizing all of OpenAI’s technologies, including AGI, once it is developed.
This move could be part of OpenAI’s strategy to attract further financial backing and support for its ambitious goals. The reports cited sources familiar with the situation, who stated that discussions are underway, but no final decision has been made regarding the removal of the clause.
The clause was put in place to ensure that AGI development remains aligned with ethical and safety considerations, preventing commercial entities from exploiting the technology prematurely. According to OpenAI’s website, “AGI is explicitly carved out of all commercial and intellectual property licensing agreements,” and the organization’s board will determine when AGI has been achieved.
Additionally, OpenAI has been considering a structural shift. In September, it was reported that the company was exploring the possibility of transitioning to a for-profit entity, moving away from its non-profit governance. This restructuring would mark a significant change in how OpenAI operates, as it seeks to capitalize on its innovations and secure more funding.
In October, the company raised $6.6 billion in a funding round that valued it at $157 billion, underscoring the growing interest and confidence in its future prospects.
With these changes, OpenAI is positioning itself for a new phase of growth and technological advancement, but the outcome of its discussions with Microsoft and its shift in corporate structure will play a key role in shaping its future.
